My wife divided our joint assets before we had a separation agreement. Is she held for losses/waste against her half of assets? – Kirk

Answer:

Kirk: If you now have a separation agreement, the answer should lie therein. If not, then you have a technical argument that the court should add everything up and redivide it. I have made that argument before and lost however. It seems the judges are resistant to undoing what the parties have already done and will find an agreement by conduct that once divided the assets are separate property.
