Daniel R. Burns is an attorney, trained mediator, and retired Niskayuna Town Justice with an office in Latham, New York. He is also a guest lecturer on mediation at Albany Law School and was formerly an instructor at the Schenectady County Community College.

Dan received his mediation training at the Center for Mediation in Law in New York City and the Mediation Center, Inc. of Eugene, Oregon. He is the Vice President and a board member of the New York State Council on Divorce Mediation, is an Advanced Practitioner Member of the Association for Conflict Resolution, and is a member of the New York State and Schenectady County Bar Associations.

How Divorce Mediation Works

Whether you want a legal separation or a divorce, you will need an agreement between you and your spouse that settles key issues such as parenting of minor children, child and spousal support, and the distribution of your property and debts.

Traditionally, this agreement is reached using the attorneys you both hire to represent you. You communicate with each other through your attorneys and they negotiate these issues for you.

If the attorneys are unable to negotiate an agreement, a judge decides these issues for you. Your attorney will attempt to predict what he or she believes the court will do in the event the matter was presented to a judge for a decision. Of course, your spouse's attorney is doing the same thing.
