Marriage on the rocks? Better watch your digital dalliance. What used to require a private eye and physical evidence better left to the imagination can now come back to haunt couples in the throes of divorce as a digital trail of infidelity, hidden property or other incriminating evidence lurking in cyberspace.

According to the American Academy of Matrimonial Lawyers, a survey of divorce attorneys reported that 79 percent have seen more divorce cases submit Web browser histories into evidence. Forty-four percent of those attorneys have also seen spyware used to obtain information from a spouse's computer.
