Phoenix, Arizona, Family Law Attorneys Creating Smart Legal Solutions

Family Law Overview

Family law is the legal specialty focused on matters such as adoption, divorce, legal separation, paternity, custody and child support, guardianship, and marital property division.

A spouse who desires to end a marriage can seek an annulment, legal separation, or divorce. If there are children, an agreement must be reached as to the living arrangements and financial support of minor children. In resolving issues of custody, courts look primarily to the "best interest of the child."

At Robaina & Palomino, we agree that the emotions, health and well-being of children of divorcing parents should be the top priority for everyone, including your attorney. We have seen how bitterness can devastate families and children, especially when one spouse uses custody and visitation to try to punish the other parent.

Divorce and other family law cases usually go to trial only when the parties cannot reach a financial settlement or when there is a custody issue that cannot be resolved. When this happens, all of the decisions concerning marital assets and child custody will be decided by a judge who knows little about your personal circumstances or relationships with your children.

Alternative Dispute Resolution: A better way for many families

Not every family law issue needs to be fought in court, which is an expensive and time-consuming way to go. In many cases, using mediation or collaborative law approaches is a better alternative, when both parties agree to enter into negotiations in a spirit of cooperation.

Mediation can work when a neutral third party, usually an attorney, assists the couple in reaching an amicable agreement.

Collaborative law involves using specially-trained lawyers to resolve family law and business disputes through a confidential process that gives the parties more responsibility for coming up with creative solutions than does traditional litigation.

Mediation and collaborative law allow each spouse to cooperate in the proceedings, empowering them to control the ultimate decisions regarding their issues, rather than having a judge make an all-or-nothing decision.
