Collaborative Law is a revolutionary process used by many couples going through divorce.  Divorce can be painful, stressful, and devastating. Litigation and courtroom battles can add to the pain and stress of divorce. Collaborative law is a process where the parties and their attorneys agree to resolve all aspects of their divorce without going to court. The process is based on principles of cooperation, openness, civility, honesty, and respect. In a typical collaborative divorce, the parties and their attorneys will enter into a collaborative law participation agreement. The participation agreement will allow for the appointment of a neutral financial advisor to assist with the financial aspects of divorce, and the appointment of a neutral mental health professional to assist the parties with the emotional aspects of divorce. The “collaborative team” will assist the parties with all aspects of their divorce by focusing on the primary long-term and short-term goals of the parties. The collaborative process allows the parties and the collaborative team to work together on solutions that will best meet the parties’ needs for the future. The collaborative process also allows for much more creativity in developing solutions and resolving disagreements. The key to the collaborative process is communication. In many cases, the collaborative process will help the parties involved in a divorce enter into a final agreement that is fair, and will best meet the parties’ needs for the future.
