MEDIATION: Helping you create your own solution

Choosing to mediate your family law issue with Jane B. Freidson – whether it be a prenuptial agreement, the terms of a separation or divorce, or a non-traditional family issue – can save you more than money alone. Jane can help you and your partner go beyond the unproductive communication of your past relationship and help each of you to express your needs for the future. As your impartial mediator, Jane will not represent either of you as an attorney, but she will discuss with you all of the legal issues raised by your particular situation and share with you how these issues might be resolved absent an agreement.

In the mediation process, you and your partner are empowered to discuss with one another the issues you face and to reach a lasting agreement which preserves the well-being of your children and your own self-respect and dignity. Mediation is one hundred percent voluntary; neither of you will be forced to make any agreement you have not decided is in your family’s best interest. The timing of mediation is completely within your control, so that you might try out a temporary solution and then return to refine it before reaching a final agreement. And of course, mediation is often much less expensive than the adversarial process in which both of you hire lawyers to do battle for you.

In contrast to many other mediators, Jane is a family law attorney with thirty years of litigation experience in New York City. She has conducted hearings and trials in Family Court and Supreme Court, on issues ranging from custody to grounds for divorce to equitable distribution and child support. Having often represented children in custody cases, Jane will help you consider your children’s needs even as she helps you resolve your differences in the way you both decide is best.

Jane’s intimate experience with how high conflict divorce and custody cases are resolved in court informs her capacity to mediate all family law issues. She will discuss with you in mediation how the court system might analyze your situation and she will ensure that any agreements you reach are agreements you can live with going forward.

Whether you want to negotiate a prenuptial agreement, negotiate a separation agreement or a divorce, or resolve a conflict that arises after a divorce, Jane can help you reach agreement on all issues in a flexible, open and safe process afforded by mediation. Because she is a licensed lawyer in New York, Jane can write your agreement for you and supervise its execution, thus ensuring that it will be legally enforceable in the future. If you have reached your agreement and are ready to seek an uncontested divorce, Jane can handle that as well.

Free Telephone Consultation

Jane offers free telephone consultations for both you and your partner to discuss the reasons you are thinking about mediation and any questions you might have about the way she conducts the mediation process. If you both agree to mediate, you can schedule a meeting to begin. At your option, and depending on scheduling, Jane will co-mediate with a certified social worker at no additional charge.
