Collaborative Divorce
Collaborative Divorce is a method of navigating through the divorce
process with less stress on both the parties and their children. It
helps everyone involved deal with the emotional, financial, and
legal issues that arise in every divorce case in a more healthy way,
which preserves the family dignity and gives the parties greater
control over the final outcome. It uses a team approach to help the
parties communicate better and thus keep everyone out of court.
The team in a collaborative divorce can include:
- the parties;
- the parties' lawyers;
- the parties' divorce coaches;
- a child specialist; and
- a financial specialist.
The job of each of the "professional" members of the team is to educate the parties and help them in the decision-making process. For example, the lawyers ensure the parties understand their rights and prepare the legal documents. The divorce coaches teach the parties the communication skills necessary to discuss the many issues with each other. The child specialist educates the parties about their children's needs and the struggles they are going through. The financial specialist educates the parties about the financial issues caused by the splitting of assets. Together, the team develops parenting and financial plans, with a focus on the parties' specific needs, that avoids confrontation and long-term stress.
