The Family Mediation Process

With the aid of professional help, mediation offers a fair process for divorcing or separating couples, where they can discuss and decide arrangements and support for their children, as well as division of property and other related issues. This is a joint effort by both husband and wife. A mediator will not act as an attorney for either or both, but mainly as an unbiased observer while striving to minimize adversarial elements and saving time and money. Through a series of meetings, all parties can discuss and decide various topics either independently or with the guidance of a lawyer or advisor.

Upon agreement by both parties, a mediator will compose a draft of the agreement for both parties to review with their attorneys. The completed and signed agreement is enforceable and, if part of a divorce, may be presented to the court for approval.

A vital key to the success of mediation is the willingness and effort by both parties to reach agreement. This effort from both parties is voluntary, as it is understood that there is no legal obligation to agree.
