Divorce Mediation & Litigation Support
Mediation is a confidential process where a neutral mediator helps disputing parties to identify and discuss issues of mutual concern. The parties participate voluntarily, making their own decisions throughout the process and controlling the outcome of the discussions. The mediator does not provide advice or judge the fairness of any options offered. Rather, the mediator facilitates a conversation to establish what each party wants, thereby enabling the parties to develop a resolution acceptable to all. Mediation is an appropriate means to resolve any conflict where the parties involved participate voluntarily and are motivated to develop an agreement that improves their situation.
Mediating a divorce settlement helps protect couples (and their children) from the destructive effects of adversarial divorce. It allows individuals to focus on the future rather than dwelling on the past to develop thoughtful and lasting terms for separation. For couples with children, mediation helps them separate their spousal role, which is ending, from their parenting role, which is continuing. Because of the flexibility of the process, mediation is often the best way to design an appropriate custody arrangement and parenting plan that considers the interests and needs of both parents and those of the children.
Divorce mediators are knowledgeable about the law but do not provide legal or financial advice to either party. They will raise issues about which couples must make decisions, but they will not advise. Accordingly, both parties are encouraged to seek advice from separate legal counsel. Obviously, some cases are more complicated than others and couples work at the own pace, but usually couples can develop an agreement that works when they participate in the process with open minds.

Jody Davis, a Founding Partner of Davis, Monk & Company, is a Partner in the Gainesville office. He is a member of the American Institute of Certified Public Accountants and a past president of the local chapter of the Florida Institute of Certified Public Accountants. Jody has assisted in various contract negotiations for the sale and/or purchase of various businesses. An arbitrator, Jody has arbitrated small to multimillion-dollar disputes and is currently on the neutrals panel of the American Arbitration Association (AAA). Jody's personal approach to these negotiations is creative and has enhanced his reputation throughout North Central Florida.
Jody has extensive experience in estate planning and has valuated companies for estate and gift purposes. He has also testified in court on valuation of operating companies and medical practices and was a founder and past president of the Estate Planning Council of Gainesville. Jody has also received the Certified Financial Planner (CFP®), Personal Financial Specialist (PFS), and the Certified Senior Advisor (CSA) designations and is a member of the American Association of Individual Investors. He holds Insurance and Series 7 and 66 securities licenses and offers life planning services to his clients through Davis-Monk Financial Group, Inc. (a registered investment advisory firm).
Jody is certified through the Supreme Court of Florida as a Family and County Court Mediator. He was instrumental in the founding of the North Central Florida Mediation Council and served as its first President. He is a member of the Association for Conflict Resolution and the Florida Academy of Professional Mediators.
Active in the community, Jody is a past president of the Gainesville Area Chamber of Commerce, has served as a former Board Member of both the Gainesville Jaycees and the Gainesville Rotary Club and is a Paul Harris Fellow. He is a founding board member of the Gainesville Area Innovation Network (GAIN) and the Gainesville Sports Organizing Committee (GSOC). He is a member emeritus of the Steering Committee for the Fisher School of Accounting at the University of Florida, chairman of the advisory committee for Dragon Rises College of Oriental Medicine, and is a board member and past president of the Santa Fe Community College Endowment Corporation. He is a founding board member of Florida Citizens Bank after having been a board member of Barnett Banks of Alachua County. Jody recently became a board member of AvMed, a state-wide HMO operating in Florida with primary offices in Gainesville and Miami.
