Mediation: A Better Way
The life change you are considering will affect you and your closest family and friends in many ways, for many years. You're not alone if you feel afraid, confused, and uncertain at this time. As the marriage breaks down and divorce becomes a serious consideration, couples can use mediation to find the answers to the many questions that will arise.
What is Mediation?
Mediation is a unique, relationship-oriented solution in divorce.
Instead of focusing more on right vs. wrong, win vs. lose, and who will prevail in court, our approach is designed for couples who feel they can cooperate and help each other toward a settlement, with little or no attorney involvement. This is especially important when children are involved.
In private, confidential sessions a neutral mediator helps the couple focus on their future needs and interests. The couple is in control and their understanding of fairness is followed. Attorneys, if retained, are seldom present in our sessions, but instead remain in an advisory role.
We are a partner in finding answers to:
- A fair division of debt.
- The equitable division of checking and savings accounts.
- Dividing investment and retirement accounts.
- Options for ownership of personal property: real estate, autos, RVs, furniture, etc.
- A future budget for each spouse.
- Child support/spousal maintenance, if applicable.
- A flexible parenting plan that allows both parents to continue a close, loving relationship with their children.
We arrange the final paperwork.
We not only help you design a fair, equitable settlement, but we draft a Memorandum of Agreement for a mediation-friendly attorney's use when preparing and filing the necessary legal documents, through the final divorce decree. You may not even have to appear in court.
Maybe, some help.
Divorce is one of the most difficult changes in life and too many people try to navigate this path alone. Often, we will recommend the services of a professional therapist to help an individual spouse, the couple, or their children so that mediation can be conducted in an atmosphere of respect and cooperation.
The client's view of the mediator?
Helpful, encourages self-determination, non-judgmental.
The mediator's view of the client?
Competant and able to make their own decisions once they understand their choices.
About Kent
Kent Peterson is the founder/managing partner of Mediation One LLC. He has more than 30 years of experience in mediation, finance, banking, real estate, insurance, and investments.
He is a client-centered Mediator, where the couple is in control of discussions toward a final agreement. He is registered with the state of Minnesota as a qualified neutral under rule 114 of the MN General Rules of Practice.
He is also a Certified Divorce Financial Analyst (CDFA), offering his clients a unique resource during discussions: a detailed picture of each spouse's financial future under any given settlement scenario for the next 5, 10, or even 20 years after divorce.
Kent is an outdoorsman, and likes to compare his work to that of a fishing guide:
"If you're going fishing for the first time on a large lake and want the outing to be successful, you would probably hire a guide. Usually, my clients have never been 'on the water' of divorce, so I act as their guide through the process to a successful agreement."
