Collaborative Divorce
The Collaborative Process is about cooperation, not confrontation. It is a process where everyone agrees to work together (to collaborate) to create acceptable solutions that work well for both parties, without going to court.
There are important differences between the collaborative approach and the traditional approach. In the collaborative approach:
- Both parties agree to stay out of court
- The emphasis is on creating solutions that address the values and goals of both parties and their children
- The sole objective is to reach an efficient, fair comprehensive settlement of all issues.
Clients are invited to consider how they want to resolve matters and how they might best go about creating or achieving positive solutions for themselves, their children, and their families. This can bring about a completely different outcome from the traditional adversarial approach.
You and your spouse and both collaborative lawyers work as a team, using informal discussions and conferences to settle all issues. It generally takes much less time and money to settle matters using the Collaborative Process. In this process both clients will treat each other with respect, listen to each others’ perspectives, interests and concerns, explore all possible choices, and let go of the past to focus on the future.
All parties, and especially the children, benefit from the collaborative process. The atmosphere is one of collaboration or working together toward solutions, as opposed to the adversarial approach. Because there is less animosity it is much easier on children.
Mediation
Mediation is an alternative to fighting in court with your spouse through attorneys. Instead of court, I can assist parties who decide to use mediation negotiate issues concerning child custody and support, spousal support, and division of assets and debts.
Mediation facilitates a better relationship with your spouse, and spouses who mediate their divorce typically are better able to communicate and cooperate and to reduce tension for the sake of the children.
Typically mediation is significantly less expensive than a litigated divorce, and is also less time consuming. Mediation can only work if each spouse is honest and openly discloses all facts, records, and documents required to ensure an informed and fair agreement. It is important that both parties feel that mediation is a fair forum in which to resolve their concerns and differences.
As a mediator, I do not represent ether party, but provide a neutral and supportive forum to facilitate a fair and reasonable resolution for both parties.
Unbundled Services
Limited scope, or unbundled services, allows you to retain an attorney to handle only the specific areas that require expert legal assistance.
Limited scope covers a range of legal services. Rather than being retained to handle your entire case, you may retain my services for the limited purpose(s) of your choice. For example, you may want assistance with strategy, document preparation, ghostwriting, coaching for mediation, and even appearing in court for a limited purpose, such as arguing a single motion, or handling a single issue, while you handle the rest of your case.
The benefit to you is that you can manage your litigation budget by doing parts of the case yourself and retaining legal services for tasks that you do not think you can do effectively yourself.
Biography
I practice law in accordance with my values. These include respect for the inherent worth and dignity of every individual, and justice, equity, and compassion in human relations. Consistent with these values I provide innovative legal tools to resolve disputes, including mediation and Collaborative Law.
Divorce is not primarily a legal problem. It is an emotional problem with legal consequences. And in most cases, traditional litigation only serves to exacerbate both the emotional and financial problems, and is a poor way to deal with the legal consequences. There is a role for litigation, however, where a spouse is unable to be honest and respectful, or where there is addiction or domestic violence.
