Mediation
What is mediation? Mediation is a voluntary process that can often be utilized by parties who have a dispute to resolve their conflict. Oftentimes, mediation can assist the parties and minimize court involvement by allowing them to negotiate their own agreement, without the necessity of expensive and relationship-damaging litigation.
Successful mediation is conducted by a neutral third party who acts as a moderator and as a tool for the parties to achieve their own agreement. Mediation is geared toward encouraging communication between the parties and allowing them to craft their own resolution based upon their own individual needs or the needs of their family.
Many believe that mediated settlements are much more family-oriented and permit the individual families to develop a routine that works for their family. Parties who mediate, rather than litigate, appear to be more satisfied with the process than those who are "court ordered" to perform in a specific way.
Mediation can be conducted before a court action has been filed. It can be utilized to avoid litigation and resolve divorce issues (including asset and custody matters) as an alternative to the court system. Some parenting plans even include a provision requiring parties to return to mediation to attempt settlement prior to filing a court action.
Attorney Garner is listed as a Rule 31 Family Mediator by the Tennessee Administrative Office of the Court. Ms. Garner has successfully mediated numerous family disputes, employer/employee disputes, asset distribution, and custody arrangements. Education
Attorney Garner received her undergraduate degree from South College, a small private college in Knoxville, Tennessee. Ms. Garner received her law degree from the Nashville School of Law.
Experience
Patti Garner worked as a paralegal for approximately 10 years. During this time, she was completing her undergraduate degree and attending law school. Ms. Garner has assisted with multiple murder cases, DUI defense, divorces, setting aside a forged will, and multiple personal injury and disability cases.
Attorney Garner began working as a family mediator in 2000, although she was not listed by the Administrative Office of the Court until 2007 as a Rule 31 Mediator.
Volunteer Work
In 2008, Patti Garner dedicated much of her volunteer time to help with the Sumner County Mock Trial Competition and Teen Court. Working with the youth of the Sumner County area is personally rewarding to Ms. Garner.
She has been a CASA volunteer since 1998. She has worked with SafeSpace to achieve their goals of seeking pro-bono counsel on behalf of numerous victims of domestic violence since 1997. In 2006 - 2007, she also assisted with a pro-bono project in Sevier County that provides pro-bono counsel to victims seeking orders of protection.
Ms. Garner interned with the Public Defenders Office in the 4th Judicial District of Tennessee. She served as a student representative for the Tennessee Bar Association during law school and co-founded the NSL Legal Society.
