Marriage Dissolutions : Dissolution of marriage represents a new beginning for an entire family. Each dissolution is unique. As a result, an emphasis is placed upon understanding the emotional as well as the financial impact of dissolution. Decisions made on issues such as property distribution, maintenance, child support, and residential placement and visitation of children will affect the client, the opposing party and the children for years to come. Our objective is to help the client focus upon the long-term implications of their individualized dissolution goals. Parenting Plan Modifications : Often, modifications of parenting plans are extremely emotionally taxing for the parents, but in particular, for the children involved. Although we have represented mothers and fathers in successful efforts to modify their parenting plans, our focus upon the children's well-being does not waver. Specific strategies to avoid involving the child in the conflict between the parents are discussed with the client as appropriate. Additionally, we will suggest alternatives such as parenting classes and counseling to help make the client the best possible parent they can be, regardless of the outcome of the litigation. After all, the parent-child relationship will exist long after the court battle is over.
Child Support Modifications : Our representation of clients in child support modifications is very thorough. Attention to detail is crucial when support amounts are calculated, no matter how complex or streamlined an individual's financial situation may be. In an effort to furnish cost-effective representation for the client, we attempt from the very beginning to provide him or her with a realistic range of possible support amounts that could be ordered by the court. In doing so, we have found that a positive and realistic framework for settlement discussions is in place.
Child Support Enforcement : For some parents, difficulties exist in obtaining the paying parent's compliance with a valid child support order. In order to assure that support for a client's children is timely and consistently paid as ordered by the court, a full array of remedies is utilized by this office from negotiation to seeking the imposition of contempt sanctions. Additionally, other parents may face punitive, and, sometimes even harassing, enforcement measures in which an aggressive and thorough defense is necessary to protect their rights and interests.
Paternity Matters : Paternity is another area that represents a new beginning for a client, the other party and the child involved. While each paternity matter is unique, our aim is to focus in on long-term strategies that best suit the client's particular needs. Determination of parentage of an alleged or presumed father is a vital issue with long-range implications, as are establishment of a residential schedule and support obligation. More often than not, paternity matters will involve a child of tender years. As a result, an emphasis is placed upon achieving some sort of cooperative parenting atmosphere for the parties since they will have to raise their child for many more years.
Cohabitation Claims : Referred to as meretricious relationships, cases involving cohabitation claims can be quite emotionally taxing for the client. Not only is there some distress over the break up of a relationship, but there also may be legal ramifications as well. Generally speaking, in cohabitation claims one party believes that he or she did not receive their fair share of the parties' accumulations while they were together. Conversely, the other party typically does not believe any such entitlement is necessary, or even deserved. Often, settlement of a cohabitation claim is difficult to achieve since the parties have great differences of opinion about the quality and nature of their relationship. As a result, cost-effective litigation is at a premium.
Post Secondary Support : Seeking support beyond a child's eighteenth birthday or after they have graduated from high school can be met with a great deal of resistance. Many people are in the dark about the notion of support continuing beyond age eighteen or high school, and, as a result, are usually quite surprised by a request for an award of post secondary educational support. Effective communication between the parents in anticipation of a child's college or vocational education is ideal, but oftentimes not achieved. When that occurs, communications regarding a settlement take on even a greater priority since the adult child is facing deadlines for registration and tuition payments.
Protection Orders : Physical harm, bodily injury, assault, fear of imminent physical harm, sexual assault or stalking by another family or household member is a terrifying situation that some people unfortunately must face. In our state, laws exist to help an individual obtain protection from the court in such situations. From the initial filing of a petition for an order of protection and service upon the other party, to court hearings on the petition and its enforcement, our representation focuses upon walking the client through every critical step of the legal process to help ensure their personal safety.
