The filing of the "Original Petition for Divorce" begins the divorce process. It is the document that asks the court to legally dissolve your marriage. This document will be served on your spouse to advise him or her that a divorce action has been filed, regardless of whether he or she wants a divorce. If your divorce is uncontested, your spouse may be willing to waive service to save the cost and embarrassment of having a private process server go to your spouse's office or home. These and other matters involving divorce will be discussed in your initial interview with the attorney.
