Uncontested Divorce

An uncontested divorce if it is truly uncontested is relatively simple and low cost. The most difficult part of an uncontested divorce is determining whether it really is an uncontested divorce.

The most basic uncontested divorce is one where both parties agree that they want a divorce, the parties have met the requisite amount of time required by law of remaining separate and apart with the intent of permanently remaining separate and apart, there are no children of the marriage, no properties to be split between the parties, the other party is not going to use a lawyer to contest any aspect of the divorce and will willingly sign all necessary documents to effectuate the divorce.

Contested Divorce

Generally, a divorce that consists of any significant amount of property and/or children results in a contested divorce. A contested divorce does not have to be an end-of-the-world event, provided both parties attempt to resolve the issues of property and custody in an equitable manner. How contested a divorce is going to be is in great part determined by the parties and the lawyer each party chooses to represent him or her. Even a contested divorce can be handled rather amicably if both parties choose to be reasonable and neither attorney chooses to engage in scorched earth behavior. More often than not, the opposing attorney will play a great role in how amicably a contested divorce can be resolved. This, in turn, will determine how expensive or inexpensive the contested divorce will be for the parties. How your case will proceed will greatly be determined by the specific facts of your case.
