My ex won't let me see my child. What can I do?

Answer:

Child visitation is generally considered to be the right of any parent. Even a parent who has been found to be unfit may be entitled to some amount of supervised visitation by the court. The purpose of this is to ensure that a child is able to maintain a relationship with both of his or her parents, which is widely viewed as in the child's best interests. As such, if your ex will not allow you to see your child, there are some things you can do:

  • If you do not have a custody arrangement in place, you can take your spouse to family court to get a formal decree from a judge. At court, you'll be able to make an argument for why you should be able to have visitation with your child. You can even request partial or shared custody, provided you can prove you will provide a stable environment for your child.
  • If you have a custody decree in place already and your spouse is not abiding by it, you can go back to court with proof your spouse isn't following the rules. She may be held in contempt of court, or otherwise suffer legal sanctions. A sheriff may be able to enforce your agreement and in some extreme cases where one party is totally unreasonable, the custody arrangement may even be changed
