Question:

If one party files divorce, the sheriff notifies the spouse, but the spouse neglects everything past the six months and does not go to court, what rights does the neglecting spouse have with alimony, property, kids, etc?  -- Kenneth

Answer:

Kenneth:  If a party does not show up for the divorce trial, and does not file an appeal within the required time, then the court's order on alimony, property and the kids becomes final.  If you just miss an initial conference or scheduling hearing, then you may still be able to contest those issues.  If there was no notice of hearing, you can ask the court for permission to file a late answer to the complaint.
