Question:

My friend's brother's wife changed the locks on their home after he told her he wanted a divorce. Is this legal? If he decides to stay with his sister, can he be accused of abandonment? We have looked in a resource book but have been unable to find the answer. – Connie

Answer:

Connie: An owner can change the locks to their house. A co-owner can hire a locksmith or break a window to get into their own property. It is not abandonment if you are locked out. If you lock your spouse out, you might be guilty of constructive abandonment.
