Question:

My wife wants a clause in the separation agreement that there can never be cohabitation with another woman while my daughter is present (unless I marry again).  Another clause for not introducing her to anyone I'm dating unless I've been seeing them for 3 months.  I have always put my daughter (9 yrs old) first in my life and would never put her in an uncomfortable situation.  Are these type of clauses legally binding?  If so, what are the chances that if we end up in court, a judge would allow them in the final decree? -- Mike

Answer:

Mike:  They are binding.  I've never seen a judge include them in a final decree after a trial, but anything is possible.
