What rights do I have to child custody in a separation if the child is not biologically mine, however I have been told by my wife that she has DNA result to confirm he is not but my name is on his birth certificate because we were married when he was born. -- John

John:  There is a presumption in my state that a father is the legal father of a child born during marriage, whether he is the biological father or not.  The legal father would have joint legal and physical custody of the child until and unless a court orders otherwise.
