Question:

When I filed for child support, they put him in arrears dating back to the date of filing of the action as indicated in the divorce papers which was Jan 2010.  Today I found out that his attorney has filed an Order to Show Cause.  What's the likelihood of this actually being heard or anything in the initial action being overturned? What takes place now? I don't understand because he never responded to any of the documents that my attorney served him (certified and in person) and never got an attorney until now. -- Lisa

Answer:

Lisa:  An attorney files a proposed Order to Show Cause why a party should not be held in contempt for violating a court order. It is usually accompanied by a Motion for contempt.
