My wife has served me with a motion to show cause hearing. What does this have to do with alimony?

Answer:

Alimony and child support are court ordered payments that are made as part of a divorce agreement or marital separation.  Once the court has ruled that these payments must be made, violating the order of the court to pay these debts in a timely fashion can lead to fines or even prison time.  If you have been filed with a motion to show cause hearing by your former spouse to whom you owe alimony payments, there are a number of different possible reasons the motion may have been filed.

  • The main reason that you may have been served with the motion to show cause is because you are behind in your court ordered alimony payments or are not making the proper number or amount of payments based on the court ordered alimony schedule that was set forth at the time of your divorce.  
  • If you have been served with a motion to show cause order regarding alimony, it will be up to you to provide evidence to the court that you have been making your court ordered payments and complying with the alimony agreement, or you may face fines or other censures.
