Dissolution of marriage can be a costly and difficult time for all involved, especially when issues cannot be agreed upon. Going thru a trial in a dissolution of marriage is a time consuming process. Many people are involved and the trial and outcome then becomes public record. Mediation is an alternative to a trial in a divorce. Dissolution of Marriage

A dissolution of marriae, often better known as divorce, is when a married couple decides to part ways. Dissolutions of marriage can become very upseting when there are factors that cannot be agreed upon. This is usually when attorneys and the judicial system become involved. The dispute is often over material things, money, or children. Once a couple takes their divorce to court a judge will decide these things for them. Once the judge makes his ruling, it is so, the couple no longer has control over these factors.

Mediation

A mediation is when an independent third party meets with the couple and their attorneys together to try to solve the issues bringing them to divorce court. The mediator will not try to bring the couple back together, but will aid in the process of making agreements and compromises regarding the disputes. A mediator will not force an agreement and can make no ruling for the couple.

A mediation is a great alternative to divorce court for the following reasons:

  • Less costly
  • Less time consuming
  • No public record
  • The couple is able to speak relatively freely and work with one another rather than simply thru attorneys
  • You do not need to have an attorney to do a mediation

Remember, a mediation is not binding. If the parties cannot agree, there is nothing the mediator can do to make either party cooperate.

Preparing for Mediation

When preparing for mediation make sure you are aware of all the issues that will be discussed, this sounds obvious, but being unprepared for anything is the worst thing you could do. Anticipate any new issues that may be brought up.  It is okay to take in notes to help remember your points. Also, bring any documentation you feel may sway your former spouse. Being organized, staying calm and having all documentation with you will be key to a good outcome in a mediation.
