Solutions to health care coverage problems:
If your court order provides the other parent shall provide health insurance coverage for your child you can:
- Enroll the child in the other parent's health coverage through the employer if the other parent fails to do so without waiting for an open enrollment period.
- Obtain information needed to use the insurance coverage directly from the health insurer or the employer if the other parent fails to provide you with this information.
- Submit claims directly to the health insurance carrier.
- Obtain reimbursement checks payable to you from the health insurance carrier for medical expenses you have already paid.
Please be prepared to be patient in attempting to exercise these new rights. The legislation was effective December 22, 1995, and many businesses and insurance companies may not yet have procedures in place to accommodate your requests.
Feel free to refer them to the State of New Jersey Legislative Services office for a copy of the new legislation or obtain your own copy at no cost.
