Question:

My husband of 4 yrs has moved out, leaving my son and me in the home we purchased last year. The mortgage is in both of our names. He has agreed to give up his rights to the home. My concern is that the mortgage co., may require refinancing, in which case, I doubt that my income would qualify. Is there a way I can just take over the mortgage? – Linda

Answer:

Linda: The mortgage company cannot require you to refinance because of a separation or divorce. You can agree with your husband that you will be responsible for the mortgage payments.
