Question:

Retained join ownership of the house to maintain stability for my kids. Mediator helped us to file and left the sale of the house as something that can be review based on market dynamics and children's stability. My ex lives in the house and is now intending to remarry in July 2011.

As I continue to pay a portion of the house (half taxes and small amount of mortgage) I do not want to continue my ownership in the house given she intends to have her new spouse move in with her and begin a new life together. She doesn't want to sell the house and is not positioned to buy me out. The house mortgage is only possible due to my credit as she has virtually no income. What options do I have to get out of the house? – David

Answer:

David: The only options you have are foreclosure, selling the house or refinancing perhaps with her new spouse. In the meantime you need to negotiate payments and how the proceeds will be divided.
